ITIS HEREBY STIPULATED by and among the parlies identified below, through their
respective counsel, that in this action:

1. Plaintiff is allowed to substitute Antony Mills as a disclosed expert. witness in place of
plaintiff's formes expert witness Jim Sappington, due to Mr. Sappington’ s recent death.

2, Plaintiffs Expert Witnesses Disclosure and Declaration.is amended to delete Jim
Sappington and the references to his expected testimony (fs 29-31), and to substitute and add the
following:

Antony Mills
29, Lam informed and believe and thercon state that Antony Mills is

an expert in the field. of:construction estimating. He has 26 years of

experience in the construction industry as an engineering aid, draftsman, lead

carpenter, foreman, superintendent, senior estimator and partner in Saarman

Construction.

30. Mr. Mills is expected to testify te the scope and cost:of remedial

repairs recommended by plaintiff's other disclosed experts, and codes, regulations

and other standards applicable.to future repairs, including but not limited to Civil

Code section 895 et seq, Antony Mills is also designated to testify to scopes and

costs of repairs addressed by retained and non-retained experts designated by any

other party.

31. Antony Mills’ fee for providing deposition testimony and for

consulting with the retaining attorney is $300 per hour.

3. Plaintiff shall make Mr, Mills available for deposition at a mutually convenient time to
be-artanged and agreed'to by the. Discovery-Committee and Mr. Mills.

4, Mr, Mills will update the cost estimates so that they will reflect the
cost of repair at time of trial,
