Karnow AND RELATED CROSS-ACTIONS DEPT: 304 TO ALL PARTIES AND THEIR COUNSEL OF RECORD: NOTICE IS HEREBY GIVEN that the Renewed Motion To Strike Portions of Plaintiff's Third Amended Complaint (hereinafter “Renewed Motion to Strike”) by defendant SKIDMORE, OWINGS & MERRILL LLP (hereinafter “SOM”), PREVIOUSLY SCHEDULED FOR September 19, 2014, will be heard on September 30, 2014 at 9:00 a.m. in Department 304 of the above entitled Court, located at 400 McAllister Street, in San Francisco, California. SOM will and hereby does move to strike all portions of Plaintiff's Third Amended Complaint (“TAC”) that seek damages against SOM concerning excessive heat gain, inadequate ventilation, and lack of compliance with California Code of regulations, Title 24, as found in the First, Second and Fifth Causes of Action. Because it seems impossible to achieve this result by simply striking specific lines of the TAC, SOM requests that plaintiff be ordered to amend its pleadings to remove any such claims for damage with respect to SOM. Similarly, as a representative example only, and not as a list of all the defective designs or details, Plaintiff is informed and believes and thereon alleges, that Defendants “SOM/HKS” recommended that the number of Z ducts be reduce by a significant quantity, which is a major factor in the nonfunctional, unhealthy condition on the interiors of the unit.” found on page 46, line 22 ~ page 47, line 3. This Renewed Motion to Strike is based on the grounds that the court may “upon a motion ... or at any time in its discretion, ... [s|trike out any irrelevant, false, or improper matter inserted in any pleading” (CCP § 436(a)) and that the TAC includes such matters as defined in CCP § 431.10.
