Constructors, Inc., dba Western Roofing Service, (collectively “Subcontractor Defendants”)
respectfully submit their order to show cause (“OSC”) hearing statement pursuant to the Court’s order
of July 28, 2015.
i. STATUS OF EXECUTION OF SETTLEMENT AGREEMENT AND REQUEST TO
CONTINUE OSC HEARING
Subsequent to issuance of the Court’s order of July 28, 2015, the parties have engaged in
efforts to finalize the settlement agreement and release. The most recent version of the settlement
agreement was circulated on August 21, 2015.
Counsel for Plaintiff submitted a case management conference statement on August 21, 2015,
which requested that the OSC hearing be continued to September 16, 2015. Subcontractor Defendants
concur with this request.
In the event the OSC hearing is not continued, counsel for the Subcontractor Defendants will
obviously personally appear on August 24, 2015. However, Sub-Contractor Defendants respectfully
request that they be excused from personally appearing at the OSC hearing in consideration of the
foregoing.
Ill. MOTION FOR THE COURT’S ORDER TO EXECUTE SETTLEMENT AGREEMENT
ON BEHALF OF CERTAIN PARTIES PURSUANT TO CALIFORNIA CODE OF
CIVIL PROCEDURE § 664.7.
Counsel for Defendants and Cross-Defendants F. Rodgers Insulation Residential, Inc., F.
Rodgers Corporation, N.V. Heathorn Inc., and West Coast Protective Coatings, Inc. served and filed a
motion to permit Defendants’ counsel to execute a settlement agreement on behalf of these four parties
pursuant to California Code of Civil Procedure § 664.7. The motion was based on the grounds that
Defendants are either not active California corporations or engaged in a bankruptcy proceeding. The
motion is set for hearing concurrently with OSC hearing. Counsel for these four parties circulated a
stipulation to counsel for all parties requesting that counsel stipulate that the Court may enter its order
granting the motion, and that counsel for these four parties has authority to execute the settlement
agreement on behalf of the four parties pursuant to California Code of Civil Procedure § 664.7.

Numerous parties have executed the stipulation and returned it to counsel for these four parties.
If the Court continues the OSC hearing to September 16, 2015, counsel for the four parties requests
that the hearing on the motion for authority to execute the settlement agreement also be continued to
September 16, 2015. Counsel anticipates that all parties will return the executed stipulation prior to
September 16, 2015.
IV. CONCLUSION
In consideration of the foregoing, Subcontractor Defendants respectfully submit their OSC
hearing statement pursuant to the Court’s order of July 28, 2015.
