The Court treats Defense Counsel Nancy McCarthy’s emails to Clerk Rob Goulding
dated April 7 and April 14, 2014 as an Ex Parte Application for modification of the April 14,
2014 Order requiring service by email of identification of documents on Privilege log by SK
Bates Number and for extension of certain deadlines in the Court’s Order of April 1, 2014. The
Court now modifies the April 14, 2014 Order:
1.
Ms. McCarthy is relieved of the obligation to produce all documents identified by
SK Bates number, which Ms. Kramer has in her possession. Ms. McCarthy only
need provide those documents that she has already prepared and identified in the
two weeks since the Court’s April 1, 2014 Order (Court Order Ruling on Motion
by Defendant on April 1, 2014 Order No. 2, pgs. 13-16). The Court extends the
deadline for completing Order No. 2 from April 16, 2014 to April 30, 2014 (an

additional two weeks). (The Court Order of April 1, 2014 noted, “[t}his work in
identifying these documents is to be done on a high priority basis...” See April 1,
2014 Court Order, pg. 16, lines 1-2.
2. The Court extends the deadline for Ms. McCarthy to submit a Revised Privilege
Log pursuant to Order No. 1 from April 21, 2014 to May 21, 2014 (an additional
four weeks).
3. After May 21, 2014, Ms. McCarthy may list supplemental, undiscovered
documents on the Privilege Log up until May 30, 2014.
No further extensions on these deadlines will be permitted.
It is so ordered.
