Submissions Part of the Supreme Coun of the State of New York, County of New York
and the Court baving rendered a decision and order dated February 25. 2008, which was
duly entered in the New York County Clerk's office on February 29, 2008 in favor of
Defendants'
Plaintiff, directing (among other things) that upon failure to comply with the
Subpoenas, Plaintiff shall settle an order on notice, together with an affinnation of
default, dïrecting entry ofjudgment against Defendants for the legal fees and costs
incurred in connection with Plaintiff's Motion; and
Defendants having failed to cornply with the Subpoenas; and
Plaintiff having submitted Ronald A. Nimkoff's affidavit of defendant's default
sworn to May 21. 2008, notice of settlement dated May 21, 2008 together with order
directing entry ofjudgment
The Court having issued an order directing entry ofjudgment dated July 2008
which was duly entered in the New York County Clerk's office on July 24, 2008, in favor
of Plaintiff awarding judgment against the Defendants in the principal amount of
$5,290 635 together with interest at the rate of 9% per annum on that principal sum
running from June 2, 2008, together with costs and disbursements to be taxed by the
Clerk upon the submission of an appropriate bill of costs:
