1. T am an attorney at law, duly licensed to practice before all the courts of the State of
California, and am an attorney at the firm of Foley & Mansfield, the attorneys of record for Defendant
FLUOR CORPORATION (hereinafter “Fluor’), in this action. I have personal knowledge of the
matters stated herein and, if called upon, would and could competently testify thereto.
2. Attached hereto as Exhibit A is a true and correct copy of Plaintiff's Personal Injury
Complaint, filed June 5, 2007.

5. Plaintiff was deposed over five days on February 10-12, 2009 and April 8-9, 2009.

Testimony, Volume V.
6. Robert Ross gave testimony in this case on January 19, 2010. Plaintiff did not identify
Mr, Ross as a witness against Fluor in his Response to Fluor’s Specially Prepared Interrogatories, and, at
his deposition, Plaintiff's counsel stipulated that Mr. Ross would not be offered as a witness against
Fluor.
7. Phillip Talley gave testimony in this case on August 18-19, 2009, Attached hereto as
Exhibit E is a true and correct copy of relevant excerpts from Mr. Talley’s Deposition Testimony,
Volumes I and II.
8. John Minster gave testimony in this case on September 9, 2009, Attached hereto as
Exhibit F is a true and correct copy of relevant excerpts from Mr. Minster’s Deposition Testimony.
9. John Minster gave testimony in a prior asbestos-related case — Shirley McClure v.
Asbestos Defendants (SFSC 407408) — on June 5-6, 2003 and July 7-8, 2003. Attached hereto as

Plaintiff's exposure to asbestos and asbestos-containing products caused severe and.
permanent injury to the plaintiff, including, but not limited to breathing difficulties, asbestosis, :
and/or other lung damage, and increased tisk and fear of developing mesothelioma, lung cancer
and various other cancers. Plaintiff was diagnosed with asbestosis and asbestos-related pleural’ :
disease on or about March 2007.
: Plaintiff’ retired from his last place of employment at regular Tetirement age. He has
therefore suffered no disability fom his asbestos~ related disease as "disability" is defined.in -
California Code of Civil Procedure § 340.2.

Plaintiff's father worked as an insulator out of Local 16. Plaintiff shared home with his father
from 1948-1960. Plaintiff recalls father coming home from work wearing coveralls that were
covered with asbestos, Plaintiff currently contends he was exposed to asbestos as a result of his
father’s employment. Plaintiff's iavestigation and discovery are continuing.
