was the legal (proximate) cause of damages to plaintiff. By the following acts or omissions to act, defendant
negligently caused the damage to plaintiff
on (date); August 17, 2005
at (place): Sacramento Street at intersection of Sacramento and Joice Streets, San Francisco, Calif.
(description of reasons for liability):
During the late morning or shortly before Noon on August 16, 2005, Plaintiff was walking
downhill on the public sidewalk on Sacramento Street, at the intersection of Sacramento and Joice
Streets in San Francisco, California. Atall times mentioned in this Complaint, Plaintiff is
informed and believes and therefore alleges that Defendants and each of them so negligently
owned, operated, maintained, repaired, positioned, located, and installed a slippery plastic box
(housing cable television equipment, and positioned in the public sidewalk) that Plaintiff tripped
and fell when she stepped on said box. Defendants and each of them also were negligent in
choosing, using, maintaining, and retaining the use of the slippery plastic material from which
said box is made. Plaintiff is informed and believes and therefore alleges that Defendants and
each of them knew of the slipping anW/or tripping hazard posed by said box and the material from
which it is made, but knowingly chose to continue using said slippery plastic boxes to house cable
television equipment placed in public sidewalks. Defendants and each of them were negligent in
maintaining a dangerous condition on a public sidewalk, failing to wam of the dangerous
condition, and failure to prevent Plaintiff and others from coming into bodily contact with a
dangerous condition. Defendants and each of them were also negligent in as much as said box in
the sidewalk is located on a hill, and Plaintiff and others walking down hill had no opportunity, or
virtually no opportunity, to see said box positioned within the sidewalk before stepping on it.

By the following acts or omissions to act, defendant negligently caused the damage to plaintiff on (date); August 17, 2005 at (place): Sacramento Street at intersection of Sacramento and Joice Streets, San Francisco, Calif. (description of reasons for liability): During the late morning or shortly before Noon on August 16, 2005, Plaintiff was walking downhill on the public sidewalk on Sacramento Street, at the intersection of Sacramento and Joice Streets in San Francisco, California. Atall times mentioned in this Complaint, Plaintiff is informed and believes and therefore alleges that Defendants and each of them so negligently owned, operated, maintained, repaired, positioned, located, and installed a slippery plastic box (housing cable television equipment, and positioned in the public sidewalk) that Plaintiff tripped and fell when she stepped on said box. Defendants and each of them also were negligent in choosing, using, maintaining, and retaining the use of the slippery plastic material from which said box is made. Plaintiff is informed and believes and therefore alleges that Defendants and each of them knew of the slipping anW/or tripping hazard posed by said box and the material from which it is made, but knowingly chose to continue using said slippery plastic boxes to house cable television equipment placed in public sidewalks.
