DECLARATION OF NON-MONETARY STATUS
1 YOU ARE HEREBY NOTIFIED that Defendant, ASSET DEFAULT MANAGEMENT,
2 INC. (“Defendant”) hereby files a Declaration of Non-Monetary Status in the above-captioned

action for proceeding as authorized by California Civil Code § 2924l(a).

YOU ARE FURTHER NOTIFIED that, in accordance with California Civil Code §
5
6 2924l(c), any parties who have appeared in the above-captioned action or proceeding shall have
7 fifteen (15) days from the service of the Declaration of Non-Monetary Status in which to file and
8 serve written objections to the non-monetary status of said Defendant. Any written objections shall
9
set forth the factual basis on which the objections are based and shall be served upon the
10
undersigned counsel for said Defendant. During the time for filing written objections, the time
11
12 within which Defendant, ASSET DEFAULT MANAGEMENT, INC. is required to file a
13 responsive pleading to Plaintiff’s Complaint shall be tolled in accordance with the provisions of
14
California Civil Code § 2924l(f).

YOU ARE FURTHER NOTIFIED that in accordance with California Civil Code §

17 2924l(d), if no timely written objections are filed and served, Defendant, ASSET DEFAULT
18 MANAGEMENT, INC. shall not be subject to any monetary awards as and for damages, attorneys’
19 fees or costs, and shall not be required to respond to any discovery requests as a non-party and shall
20
be bound by any court order relating to the deed of trust that is the subject of this action or
21
proceeding.
