DECLARATION
1, Courtney Sheats, declare as follows:
1. Twork with the Law Office of Lauren Vazquez, Counsel for Kingston Wellness, Inc., the
plaintiff in this action.
2. lhave personal knowledge of the matters contained in this declaration and if called as a
witness to testify, I could and would competently testify to them.
3. Since the discretionary revivor application was submitted on behalf of Plaintiff, I have
had almost daily contact with Noel Perez of the Franchise Tax Board.

4. Lbave timely responded to repeated requests for further infortiation from the Franchise
Tas. Board.
3. On December 1, 2014, Noel Perez of the Franchise Tax Board informed me that the
discretionary reviver application would “hopefully” take three weeks to process after the
state tax returns were posted. According to him, the returns were put into priority
processing to expedite the review.
6. Exhibit A included with Plaintiff's Ex Parte Application is a true and correct copy of the
email (received from Noel Perez.
Tp -Avthe time of signing this declaration, to my-knowledge, the review of the discretionary
revivor application was not yet cornpieted.
