PLAINTIFF hereby applies ex parte for an order waiving the fees charged by the
electronic filing service provider for mandatory e-filing.

This application is based upon California Rule of Court 2.25(b)(6) which requires the
Court to waive the fees charged by the mandatory electronic service provider when
deemed appropriate by the Court, including the fees for any party that has received a fee
waiver. This application is also based upon Cal. Rules of Court 3.1200 to 3.1207 which
set forth the requirements of an ex parte application.
. This application is also based upon Local Rule of Court for the San Francisco Superior
Court 2.10. Pursuant to this rule, Plaintiff's application is being heard in the department
to which the case is assigned rather than the Presiding Judge.

. Plaintiff has complied with the local rules for filing an application to waive the electronic
service provider fees. However, Local Rule 2.10(D)(2) requires Plaintiff to submit a
declaration stating that it has met the requirements of Cal. Rule of Court 2.25(b)(4). But
this application is not based on this rule, it is based on Cal. Rule of Court 2.25(b)(6). The
local rules do not address applications pursuant to this rule. Plaintiff's declaration
therefore sets forth facts showing it meets the requirements of Rule 2.25(b)(6) rather than
Rule 2.25(b)(4).
. Pursuant to Cal. Rule of Court 3.1202(c), this application is based on the declaration of
Jenny Jiminez, filed herewith, setting forth the facts showing a statutory basis for
granting the application.
. The attorney of record for the Defendant is Hasmik Geghamyan, located at 2323
Broadway Street Oakland, California 94612, telephone 415-857-5548.
. As set forth in the declaration of Plaintiff Counsel Lauren A. Vazquez, filed herewith, the
Defendant was appropriately notified of this application by email on September 23, 2015,
Defense Counsel responded to the email on September 24, 2015. Defendant will also be
electronically served when this application and supporting documents are electronically
filed. The transaction record of the electronic service will be attached to the proof of
service of the ex parte application and supporting documents.
. Defense Counsel has stipulated not to oppose or appear at the hearing on this application.
. For the foregoing reasons, Plaintiff respectfully prays for an order waiving the electronic
service provider fees.
