This motion is made on the following grounds: 1. Plaintiff Harold Koepke is 74 years of age. (Declaration of treating oncologist Ian C. Anderson, M.D. at { 4.) (/d., see also Exhibits B and C, Surgical Pathology Reports.) He was first diagnosed on or about July 27, 2013. id. 2. Mr. Koepke’s treating oncologist, Ian C. Anderson, M.D., opines, to a reasonable degree of medical certainty, that Mr. Koepke’s mesothelioma raises a substantial medical doubt that he will survive more than four to six months beyond the date of the declaration. (Anderson Declaration at 425.) In addition, as the illness progresses, he will become less able to attend trial and participate meaningfully in litigation. (dd. at {| 26.) 3. Mr. Koepke has a substantial interest in the case. He contends he developed mesothelioma as a result of exposure to asbestos in defendants’ products and their failure to warn him of the health hazards inherent in exposure to asbestos, including the risk of mesothelioma. Given the severity of the disease, there is a very real risk that Mr. Koepke will die before his action is tried. His ability to seek recovery for his personal pain and suffering will be extinguished upon his death. As a result, preference is necessary to prevent prejudicing his interest in the litigation. 4. The interests of justice will be served by granting preference and advancing this case for trial because without such an order and the setting of an expeditious trial date, Mr. Koepke will have no meaningful opportunity to see his case to resolution during his lifetime as intended by the legislature in passing the applicable statute, C.C.P. §36. 5. Mr. Koepke filed his Complaint for Persona! Injury on December 3, 2013. (Declaration of Carole M. Bosch, § 2.) All essential parties have been served with process or have appeared. (/d. at § 3.) 6. Mr. Koepke’s deposition is scheduled to begin on January 23, 2014. (dd. at 44.) 7. All of Mr, Koepke’s relevant, non-privileged medical, billing, social security, union, and employment records have been produced to defendants, and authorizations for the release of these records have been provided to Berry & Berry. (id. at § 5.) 8. Plaintiffs’ responses to Standard Interrogatories, Personal Injury and Friction, and Standard Requests for Production were served on December 26, 2013, January 13, 2014 and January 14, 2014 respectively. Granting this trial preference will increase the chance that trial will commence and complete while Mr. Koepke is still alive. The evidence further establishes defendants will not be deprived of a meaningful opportunity for discovery.
