The motion of Petitioner CAROL MITCHELL for an ORDER DIRECTING
COMPLIANCE WITH SUBPOENA DUCES TECUM AND AWARDING ATTORNEY’S
FEES came on regularly for hearing by the court on October 31, 2005. Petitioner

IT iS HEREBY ORDERED that Petitioner's motion for order directing compliance
with subpoena duces tectum is granted as to both subpoenas limited to Mr.
Friedenberg’s representation of each trustee of any trust in which Charles Actis was the
trustor and any determination of the competency of Charles Actis. Any documents
withheld pursuant to a claim of privilege shall be described with specificity in a
privileged log. B&P Code exempts members of the bar and their employees from the
provision of 2020.420 which requires the deposition officers to be a registered
photocopier . The court wili not determine whether any privilege attaches to any
document on this motion. That issue cannot be determined except by separate motion
addressing the various claims of privilege as they may apply to specific documents.
Compliance shall be made within ten (10) days of notice of this order. All requests for
sanctions are denied.-05-287457.
