WHEREAS this Stipulation and Order was Proposed solely by Petitioner CAROL
MITCHELL, and
WHEREAS this Stipulation and Order may not be construed, interpreted, cited
and/or relied upon as an admission as to the Propriety of any disposition of property by
the decedent herein, either by trust, will, gift or otherwise, and
WHEREAS Petitioner CAROL MITCHELL enters into this Stipulation and Order
without prejudice,
IT IS HEREBY STIPULATED AND AGREED by and between CAROL
MITCHELL as Petitioner, EVA KNOTT as Respondent, DEBRA J. DOLCH as
temporary trustee of the Revocable Living Trust Agreement of Charles Actis Dated
11/2/04 and Special Administrator of the Estate of Charles Actis, and NICHOLAS
FERRERO and NATALIE FERRERO, through their guardian ad litem CAROLINE K.
HINSHAW, that the sum of $100,000.00 shall be transferred irrevocably to DEBRA
DOLCH, to be held in trust for the minor children Nicholas Ferrero and Natalie Ferrero
under the terms and conditions set forth in that certain Will allegedly executed by
Charles Actis on August 16, 2004.
ITIS HEREBY FURTHER STIPULATED AND AGREED that DEBRA DOLCH
shall serve as temporary trustee of said funds until further order of this or any other
court of competent jurisdiction.
IT IS HEREBY FURTHER STIPULATED AND AGREED by and between the
Parties herein above named that this Stipulation and Order may be executed in
counterparts,
