In light of discover we can better sharpen issues for trial and better idea of when we will be ready for trial and trial time estimate. Court bifurcates the trial for generic questions re the rights to the common areas, both in terms of ongoing use, egress and ingress and for, perhaps if there is an issue, as to ownership. The idea is to resolve who gets to do what in the common areas and who gets to preclude whom from doing what in the common areas. Discovery previously held in abeyance is deemed served as of today. To the extent discovery has not yet been propounded it should be done now. Regarding the question of whether all potential defendants in this area have been served, Court directs counsel to provide a list of all defendants not yet served in the next case management conference statement. All participants in the determination of rights in common areas shall provide a prognosis and time estimate on what you they are working on. People in the construction defect portion of case may participate in the common area portion of case but the issues will not be tried simultaneously or overlapped.
