Dear Ms. Primus:
I represent the State of Minnesota by its Commissioner of Transportation (“MnDOT”)
and write in response to a call inquiring about what should happen with funds court
administration still has on deposit from this condemnation proceeding now that a Final
Certificate has been filed.
Please be advised that MnDOT, as the petitioner, has no interest in any amounts
deposited with the Court in a condemnation action. Pursuant to Minn. Stat. § 117.125 (2020),
once funds have been deposited by the petitioner in a condemnation action, those funds should
“be paid out under the direction of the district court.” Therefore, MnDOT cannot provide the
Court with any direction regarding said funds’ disbursement.
The funds on deposit should not be returned to MnDOT. MnDOT deposited those funds
as the purchase price for real estate that was necessary for trunk highway purposes. Those funds
belong to the prior owners as determined by the Court. It is my understanding that if money
deposited with the court in a condemnation action remains unclaimed, that money may be treated
as unclaimed property in accordance with Minn. Stat. Ch. 345.
