1/ [PROPOSED] ORDER GRANTING PLAINTIFF’S MOTION FOR RELIEF OF JUDGMENT AND
AWARDING FEES AND COSTS TO DEFENDANTSOn October 3, 2018 at 9:30 a.m., in Department 302 of the San Francisco Superior Court, th
Honorable Harold A. Kahn presiding, this Court adopted its tentative ruling. :
Satisfactory proof having been made, good cause appearing, and in furtherance of justice,
IT IS ORDERED that plaintiff Timothy Bonnici's motion for relief from judgment is granted. Th
January 24, 2018 judgment is set aside based on the mandatory relief provisions of CCP section 473(b)
Defendants Charles McMackin and Carroll Henry are entitled to an award of fees and costs of $5,000 t
be paid by Mr. Bonnici's counsel Gino Molinari no later than December 31, 2018. While this is less thar
the amount claimed by defendants, the court's own review of the additional work caused by Mr.
Molinari's admitted fault shows that the high range of reasonable fees and costs for that work is $5000.
