I, JAVAD MIRSAIDI, declare:

1. I am the principal, president and owner of Plaintiff Synergy Project Management
21
Inc. (“Synergy”). As such, I have personal knowledge of the matters set forth in this declaration and
22
could and would competently testify to those matters.
23
2. Synergy was terminated from the Haight Street Project in October, 2015. At that
24
time, Ghilotti Bros., Inc. and its President, Michael Ghilotti, assured me that GBI opposed
25
Synergy’s removal from the Haight Street Project. GBI also also assured me of GBI’s position that
26
Synergy’s work on the Haight Street Project had been performed well, in compliance with the GBI-
27
Synergy subcontract, and in fact ahead of schedule. Further, GBI represented that the gas leaks
