To the above named Defendants:
YOU ARE HEREBY SUMMONED and required to appear in this action by serving a
notice of appearance on the undersigned, Plaintiff’s attorneys, within twenty (20) days after the
service of this Summons, exclusive of the day of service, where service is made by delivery upon you
personally within the State of New York, or within 30 days after completion of service where service
is made in any other manner, including service made by delivery upon you personally outside of the
State of New York, or within 30 days after completion of service where service is made in any other
manner, including service made by delivery upon you personally outside of the State of New York.
TAKE NOTICE that the nature of this action is breach of contract and breach of warranties
for the defective installation of a roofing system on a single family dwelling and use of defective
materials for said project. The relief sought herein is monetary damages to be recovered from
Defendants for the monies paid to Defendants for the roof work and materials amounting to
$12,000.00, with interest, plus monetary damages in an amount no less than $20,000.00 for the repair
and replacement of the roofing system installed by Defendants.
TAKE FURTHER NOTICE that in addition to the damages stated above, Plaintiffs seek
costs and disbursements for this action and attorneys’ fees allowed by law.
The basis of the venue designated is the location of the single family home at issue, the
location of work performed, location of the contract and where Plaintiffs reside; all being located in
the County of Essex, State of New York.
