MARTINEZ QUINTANILLA ) ) v. ) RICHARD JOHNSON MARTINEZ FLORES ) Defendant ) ) MOTION FOR SPECIAL FINDINGS OF FACT AND RULINGS OF LAW The Plaintiff, Eduardo A. Martinez Quintanilla hereby moves that the Court conclude special findings of fact and rulings of law for the following reasons: 1. Eduardo Ariel Martinez Quintanilla is an unmarried 14-year-old born on August 1, 2007 in Honduras currently residing in Watertown, Middlesex County, Massachusetts. He intends to petition United States Citizenship and Immigration Services (USCIS) to avail himself of certain federal legislation affording special immigrant status for juveniles. See 8 U.S.C. § 1101(2) (27) (); 8 CFR. § 204.11(a). He has until his 21* birthday to petition the USCIS for this classification. 2, There are numerous prerequisites for applying for relief with USCIS. There must be findings entered by a state court having jurisdiction to make determinations regarding Petitioner’s custody and best interest. To satisfy the federal requirements, the Middlesex County Probate Court must issue specific findings when issuing its Dependency decision in order to satisfy the federal requirements. The findings that are required are as follows: a.
