Plaintiffs' Motion for Judgment on the Verdict
The motion is granted except as otherwise indicated below.
Plaintiffs' Motion for Judgment Non Obstante Verdicto
The motion is denied.
Plaintiffs' Motion to Remove the Trustees of the Lesey B. Kinsel Trust and Appoint a
Successor Trustee
The motion is granted and the named trustees are removed. Former Judge, Brent Keis is
appointed in their place.
Plaintiffs' Motion to Recoup Trust Funds Improperly Paid from the Lesly B. Kinsel Trust
The motion is granted to the extent that the current trustees of the trust are forbidden from
this date forward to pay any sum out of the funds of the trust or to or transfer any portion of the
trust assets. This prohibition includes any sum to counsel for any of the Defendants in this
matter. The motion is otherwise denied without prejudice to reconsideration upon resolution of
any appeal of this cause.
Defendants' Motion for Judgment Nothwithstanding the Verdict and Motion to Disregard
Certain Jury Findings as supplemented.
The motion and supplement are denied.
Plaintiff shall revise their proposed judgment and draft such other appropriate orders as
are necessary in accordance with the foregoing and submit them to the court on or before
December 28, 2012. The court will review the order at such time to ensure conformance with the
foregoing rulings.
