PLAINTIFFS' SIXTH AMENDED PETITION
Defendants Jackson Walker, LLP ("Jackson Walker"), Keith Branyon
("Branyon"), Jane 0. Lindsey ("Lindsey") and Robert N. Oliver ("Oliver") file their
Special Exceptions to Plaintiffs' Sixth Amended Petition.
I.
SPECIAL EXCEPTIONS
1. Defendants object and specially except to the entirety of the Petition,
because the Plaintiffs have failed to plead any facts that would support a breach of
fiduciary duty claim against them. Plaintiffs claim that Lindsey and Oliver, aided and
abetted by Branyon and Jackson Walker, breached fiduciary duties owed to Lesey
Kinsel, the decedent, whose estate is not a party to action. See Plaintiffs' 6th Amended
Petition,~~ 57-61. Even assuming that Plaintiffs' ridiculous allegations were true, which
they are not, Plaintiffs have failed to set forth any facts indicating that they would have
standing to bring such a claim regarding fiduciary duties owed to Lesey Kinsel.
Moreover, there is no allegation that the Defendants directly owed any fidu~ dut~

2. Defendants object and specially except to the entirety of the Petition,
because Plaintiffs have failed to specify the maximum amount of damages claimed
pursuant to Texas Rule of Civil Procedure 47. The Court should require Plaintiffs to
amend and specify the maximum amount of damages claimed.
II.
For these reasons, Defendants Jackson Walker, LLP, Keith Branyon, Jane 0.
Lindsey, and Robert N. Oliver request that their special exceptions be sustained and that
Plaintiffs be required to replead their Petition or the offensive portions be stricken from
it.
