         Mr. Passeser, shortly after you emailed me last night, I was called by Eric Berry, Esq. who threatened to sue me and
         move to seize certain assets as soon as today if I didn't immediately agree to "waive attorney confidentiality" with
         Akerman/Dorsey and Esposito. Your office is the only place I am aware that is seeking this very same waiver and
         information from me.

         How is Berry even aware that your office seeks these specific waivers and further aware that I have not, as of yet,
         provided them?

         I hereby make/initiate a second complaint with your office about Berry, an officer of the court, for harassing me and
         attempting to extort me. An audio file of the recorded call is attached.

         I am still represented by Legal Aid and am not waiving the advice and assistance of counsel with respect to your
         investigation and the requests you have made of me. Instead, I am separately bringing the facts of what occurred on
         October 8, 2020 to your attention. For the record, I do not own or possess any of the vehicles he believes I do (they
         were sold years ago to afford counsel).

         His threats last night were obviously designed to intimidate a witness / former client to take certain actions in an
         ongoing NYS criminal investigation. The threats were presumably made while he is in NY County, where he is
         admitted to practice law. I would imagine you have all the jurisdiction you need to investigate what happened and,
         most especially, who told him that there is a pending waiver issue and that your office is awaiting my decision.

         Lastly, I note that while I have not found invoices from Esposito, a review of my emails and other records show that he
         performed what I estimate to be at least 40-50 hours of legal services while he was engaged. According to his
         communications, he normally billed at approximately $1,000 per hour. Notably, on February 20, 2020, a full panel of
         the Appellate Division First Dept. found that the same $50k he was paid (to be general counsel as per his
         communications) was for contractual services. The 1st Dept, as I believe you are aware, vacated Lebovit's turnover
         order.

         I am concerned that people upset with the 1st Dept's rejection of Lebovit's belief that a bribe must have occurred in
         2016 may have turned to your office to encourage your investigation. What is most troubling is that these same people
         may be aware that your office has not received a waiver and may have relayed this information to Berry.

         I have more information to provide the Manhattan DA with and hope I will be afforded the opportunity to do so, with the
         assistance of counsel.
