TO DESIGNATE RESPONSIBLE THIRD PARTY

Defendant Dallas Area Rapid Transit (DART) filcs this motion for leave to designate

a responsible third party pursuant to Texas Civil Practice and Remedies Code Chapter 33.

A. Introduction

|. Plaintiff filed this suit for personal injuries claimed as a result of an accident
occurring on July 30, 2009. The accident involved a truck operated by Jerry

Lane Edgar, Jr. and a DART bus on which plaintiff was a passenger.

2. Defendant has denied and continues to deny generally the material allegations
made against it and says that it is not liable to the Plaintiff to any extent or any

amount as to any of the claims or causes of action alleged by Plaintiff.
