ENGSTROM, ) individually, GARY POPE, individually ) 15 and DOES 1 through 100, inclusive, ) DATE: 7/8/2022 16 ) ) TIME: 3 PM Defendants DEPT: 19 17 18 Pursuant to California Evidence Code Sections 451, 452 and 453, Plaintiffs Ronald and 19 Victoria Hogan (“Hogans”) submit this request for supplemental judicial notice in support of 20 their motion for an award of legal fees and costs incurred per agreement between the parties and 21 law of the case. 22 SUPPLEMENTAL REQUEST FOR JUDICIAL NOTICE 23 Plaintiffs Are Allowed to Request the Court Take Judicial Notice of a Variety of 24 Statutes, Documents or Materials as a Matter of Statutory Right 25 California Evidence Code Section 451 provides that the Court shall take judicial notice of: 26 (a) The decisional, constitutional, and public statutory law of 27 this state and of the United States and the provisions of any charter 28 described in Section 3, 4, or 5 of Article XI of the California Constitution. 1 __________________________________________________________________________________________ HOGANS’ SUPPLEMENTAL REQUEST FOR JUDICIAL NOTICE 1 California Evidence Code Section 452 provides that the Court may take judicial notice of: 2 (a) The decisional, constitutional, and statutory law of any state of the United States and the resolutions and private acts of the 3 Congress of the United States and of the Legislature of this state. 4 (c) Official acts of the legislative, executive, and judicial 5 departments of the United States and of any state of the United States. 6 (d) Records of (1) any court of this state or (2) any court of record of the United States or of any state of the United States. 7 (g) Facts and propositions that are of such common knowledge 8 within the territorial jurisdiction of the court that they cannot 9 reasonably be the subject of dispute. 10 (h) Facts and propositions that are not reasonably subject to dispute and are capable of immediate and accurate determination by 11 resort to sources of reasonably indisputable accuracy. 12 California Evidence Code Section 453 provides: 13 The trial court shall take judicial notice of any matter 14 specified in Section 452 if a party requests it and: (a) Gives each adverse party sufficient notice of the request, 15 through the pleadings or otherwise, to enable such adverse party to prepare to meet the request; and 16 (b) Furnishes the court with sufficient information to enable it 17 to take judicial notice of the matter. 18 The attached documents requested to be judicially noticed have either been filed in the matter 19 Ronald Hogan, et al. v. DeAngelis Construction, Inc., et al., Sonoma County Superior Court, 20 Case No. SCV-230846, the matter Ronald Hogan, et al. v. DeAngelis Construction, Inc., et al., 21 Sonoma County Superior Court, Case No. SCV-257566, and/or related appeals. 22 For all of these reasons, Hogans request that the Court take judicial notice of the following. All exhibits attached hereto are true and correct copies. Requests for judicial notice of statutes 23 are pursuant to Evidence Code § 452(a), and requests for judicial notice of exhibits that are 24 records of any court of this state or any court of record of the United States are pursuant to 25 Evidence Code § 452(d). 26 1. It is a fact that the Court granted Hogans’ motion to strike DeAngelis’ costs after trial. A true 27 and correct copy of the minute order denying DeAngelis’ costs is attached as Exhibit 1. 28 2. It is a fact that DeAngelis defendants struck the prevailing party legal fees provision in the 2 __________________________________________________________________________________________ HOGANS’ SUPPLEMENTAL REQUEST FOR JUDICIAL NOTICE 1 sample contract they provided to the Department of Real Estate for “Fountainview II” in 1999 2 (item 19 on page 6 of the sample contract, page 7 of the exhibit.) A true and correct copy of the 3 sample contract is attached as Exhibit 2. 3. It is a fact that in the final contract signed by Ronald Hogan, the attorneys’ fees item is 4 deleted, and the subsequent items are re-numbered. A true and correct copy of the final contract 5 is attached as Exhibit 3. 6 4. It is a fact that the March 3, 2010 order that DeAngelis refers to in their Opposition was an 7 order after hearing on DeAngelis’ motion to strike/tax Hogans’ cost bill which stated “As to Item 8 11, the motion is denied.” (DeAngelis Exhibit B.) Item 11 was for “Other: Legal Fees and Costs 9 to Date” of $588,996.03 A true and correct copy of Hogans’ memorandum of costs is attached as Exhibit 4.) 10 5.
