CJC-20-005061 LYFT, INC.’S SELECTION FOR FOURTH BELLWETHER TRIAL 30 1 Consistent with the Court’s direction, Lyft, Inc. selects for the fourth bellwether trial Marianne 2 DiTrani (CGC-19-578933 (S.F. Super. Ct.)). As the Court knows, Ms. DiTrani’s counsel (Levin Simes 3 Abrams LLP) represented they would be filing a motion to withdraw as counsel of record for Ms. 4 DiTrani. (Ltr. from W. Levin (May 13, 2022).) Although Lyft is mindful of the fact that Ms. DiTrani 5 may eventually prove to be ineligible for selection, Lyft is designating her as the fourth trial until that 6 proves to be so—and should Ms. DiTrani become ineligible, Lyft may seek relief from the Court 7 regarding the available cases for the fourth bellwether trial. 8 As background, Plaintiffs and Lyft each selected six cases for bellwether discovery. One of 9 Lyft’s initial picks was Jill Berquist (CGC-19-578643 (S.F. Super. Ct.)), who subsequently stopped 10 participating in this litigation, rendering her presumptively ineligible for selection as a trial candidate. 11 Another of Lyft’s picks was Nicholas Kowalski (37-2020-20365-CU-PO-CTL (S.D. Super. Ct.)). His 12 counsel voluntarily dismissed the action with prejudice after Lyft noticed his deposition. And now Ms. 13 DiTrani’s continued participation in this proceeding may be contingent on her finding new counsel.
