On October 4, 2010, an oral hearing was held on Citibank (South Dakota), N.A.’s and Citicorp Credit Services, Inc. (USA)’S Motion to Compel and Enforce Rule 11 Agreement. The Motion was granted and the Defendant and Defendant’s Counsel were ordered to fully comply with the Rule 11 Agreement no later than October 18, 2010. As of the date hereof, the Defendant and the Defendant’s counsel have failed to comply with the Court’s Order. Accordingly, additional time is needed to finalize this matter, and Plaintiff respectfully requests the Court extend the final disposition/dismissal hearing scheduled for October 25, 2010, for a period of at least 90 days.
