Somaiah Kurre; in the 80" Judicial District Court of Harris County, Texas Dear Judge Weiman: As you will recall an oral hearing was held in the referenced case on May 25, 2018 to consider Defendant’s Amended Motion for Judgment Notwithstanding the Verdict and Motion for New Trial. At that time, the Court made certain rulings and instructed me to file another proposed Final Judgment consistent with the Court’s findings from the bench. Thereafter by Order dated june 1, 2018, the Court vacated the Final Judgment dated 3/20/2018. We have filed today, contemporaneously with this letter, the proposed Final Judgment as instructed to specifically address with the Court’s rulings on the declaratory judgment requests of the Plaintiff and Intervenor Plaintiff. Please note that Plaintiff and Intervenor Plaintiff tender the proposed Final Judgment as “agreed as to form only” and reserve all appellate remedies related thereto. Ihave conferred with opposing counsel regard today’s filing and have been informed that the Defendant does not agree to the form of the proposed final judgment as tendered. We will appear before you this Friday at 9:00 am for the entry hearing. Please let me know if you have any questions.
