                             PARTIAL SUMMARY          JUDGMENT

        On   this day,   the Court considered Defendant/Counter Plaintiff Offshore       Specialty

 Fabricator, LLC’s (“OSF”) Motion for Partial Summary Judgment against Plaintiff/Counter

 Defendant JAB Energy Solutions II, LLC (“JAB”). After reviewing the motion, JAB’s response,

if any, the evidence and pleadings on file, and the arguments
                                                         of counsel, the Court finds that the

 motion
    for partial summary judgment is well taken and should be granted. It is therefore,

        ORDERED      that OSF’s Motion for Partial Summary Judgment against JAB is hereby

 GRANTED. It is further,

        ORDERED      that Offshore Specialty Fabricator, LLC shall have judgment against and

 recover from JAB Energy Solutions II, LLC the following:

               Damages in the principal sum of Four Million Five Hundred One Thousand Nine
               Hundred Two and 02/100 Dollars ($4,501,902.02

              Pre judgment interest at the rate of Six Percent (6%),per annum on the principal
              sum of Four Million Five Hundred    One Thousand Nine Hundred Two and 02/100
               Dollars ($4,501,902.02) starting on December 23, 2015. This amounts to $740.03
              per day beginning
                          on December 23, 2015 until the date this judgmentis signed;
               and

              Post judgment interest on the unpaid balance of this Judgment at the rate of five
              percent (%) perannum. from the date this Judgment   is signed until this Judgment
               is fully and finally paid. It is further,
ORDERED      that all Offshore Specialty Fabricator, LLC’s costs of court associated with

its counter claim are assessed against JAB Energy Solutions II, LLC. It is further,

       ORDERED       that all writs and processes for the enforcement and collection of this

Judgment
    or the costs of court may issue as necessary and when appropriate.
