In reference to the above matter, and in accordance with the Court’s Uniform Scheduling
Order dated April 12, 2011, this letter is to inform you that Plaintiff's counsel has contacted
Daniel Tostrud, counsel of record for Defendant, and he is unopposed _to_the appointment of
Mark Bukaty, located at 8117 Preston Rd.. Suite 300, Dallas, TX 75225, as mediator in the
above-referenced case. Mr. Bukaty is a highly skilled and economical mediator with expertise
mediating breach of contract cases, This letter is a formal request by me, on behalf of the
Plaintiff, that Mark Bukaty be appointed mediator in this matter.
Daniel Tostrud recently left Hermes, Sergeant, Bates LLP to join Cobb Martinez
Woodward PLLC, and his new office informed me that he is waiting for a substitution of counsel
to be ordered before moving forward with this case. Both Hermes, Sergeant, and Bates and
Cobb Martinez Woodward are being copied with this correspondence.
