24 way of an ex parte application, for an order correcting a clerical error in the Court’s April 4, 2022
25 minute order, and for an order substituting Shahram Tabatabai (“Tabatabai”), assignee, as Plaintiff
26 in substitution of Malek for all purposes pursuant to the terms of the stipulation by Malek,
27 Tabatabai, and Defendant Jeanne Turner Tabatabai (collectively the “Parties”).

NOTICE OF EX PARTE APPLICATION
1 Because a clerical error has precluded an order granting the Parties’ stipulation, and
2 precluded the Court’s consideration thereof, and because a delay in substituting Tabatabai for
3 Malek would cause irreparable harm to Malek in being compelled to prosecute claims that no
4 longer belong to him, as well as to Tabatabai’s ability to represent his newly acquired rights in the
5 forthcoming proceedings, good cause exists for the relief sought.
6 This ex parte application is made pursuant to California Rules of Court, rules 3.1200 et
7 seq., and Code of Civil Procedure sections 128, 367 and 368.5. This application is based on this
8 application, the memorandum of points and authorities and Declaration of Eric C. McAllister and
9 exhibits thereto, the Proposed Order, the pleadings and papers on file herein, and on such further
10 arguments and material as the Court may consider at the hearing on this matter.
