Motion to Dismiss Count 3 of Plaintiff's Amended Complaint, and the Court, having reviewed
the Motion, the Plaintiff's Response in Opposition, having reviewed the court file and record,
including the operative Complaint, having heard argument of counsel, and after being otherwise
duly advised in the premises, it is hereby
ORDERED and ADJUDGED that Defendant’s Motion to Dismiss Count 3 of
Plaintiff's Amended Complaint is GRANTED WITHOUT PREJUDICE. Plaintiff shall have
twenty (20) days from the date of this Order to refile an Amended Complaint alleging a
