THE COURT
Appellant’s motion filed September 1, 2021 isGRANTED. The dismissal order
filed August l9, 2021 is VACATED, and the appeal is REINSTATED. (Cal. Rules of
Court, rule 8. 140(b)(1).) The appeal was dismissed for failure to timely pay the costs for
the reporter’s transcript on appeal. Appellant filed an application with the Court
Reponers Board for reimbursement from the Transcript Reimbursement Fund. The
Court Reporters Board was mistakenly informed that the appeal was dismissed, when it
was only partially dismissed, and did not act on the application. Appellant reapplied to
the Transcript Reimbursement Fund, but the superior court clerk issued his default and
this court dismissed the appeal before the Court Reporters Board issued itsprovisional
approval of appellant’s application on August 24, 2021. {MTV, p. 25}
Appellant is DIRECTED to file with the clerk of the superior coun, appeals
division, a copy of the Court Reponers Board’s provisional approval on or before 10 days
from the date of this order. (Cal. Rules of Coufi, rule 8. 130(c)(2).) The clerk of the
superior court is DIRECTED to proceed with record preparation upon receipt of the
provisional approval.
