The Department received a report regarding neglectful supervision of Hayden Wilcox who is 5 years old by maternal grandfather, James Wilcox, and the mother’s boyfriend. Hayden was reported 4 hours after missing and was found at 7:43 am the next morning. Hayden was interviewed and reported he followed the dogs and got lost. During the interview he reported his mother’s boyfriend as pushing his head into the shower and causing his lip to bleed. He reported the boyfriend has “ slapped his winky”. Hayden stated his mother, Ashleagh Wilcox, hit her boyfriend and is the aggressor in domestic violence. Hayden’s father, Jamie Wilcox, is not allowed contact with him because of prior domestic violence with Ms. Wilcox. The Department believes there is immediate danger to the child remaining in the household and continuation of him being in the home would be contrary to his welfare. Wilcox Page 3 of 16 MA-Rev 10.30.2019 Texas Department of Family and Form 6588 Protective Services September 2017 Safety Kinship Caregiver's understanding of why child(ren) was removed from the home: Ms. Wilcox reported she has heard two different stories as to why Hayden was removed from the household. She stated she was told Ashleagh’s boyfriend hit Hayden and that caused him to be removed. She also stated she heard he was removed because he wandered off following the dogs and was removed after being found. Ms. Wilcox reported she did not know why Hayden was removed from the home if the boyfriend is not in the household. She stated the boyfriend was the reason Hayden was removed and she does not understand why Hayden is now taken out of the household. It appears Ms. Wilcox is not recognizing the negative effects of her daughter Ashleagh displaying domestic violence against her boyfriend as a risk and allowing someone who has displayed abusive behavior towards her son and leaving him in his care as a risk. Ms. McMinn and Ms. Wilcox reported they would never let any harm come to Hayden and he was well taken care of in their care. Ms. Wilcox does appear to understand why Hayden was removed because of the boyfriend but is not understanding why Ashleagh Wilcox is not able to have Hayden placed back in home. Caregiver's plan should a child or youth’s behavior present a risk to themselves or others or significantly impairs daily functioning to ensure the child/youth and caregivers have the supports needed to prevent disruption of placement and promote a safe and therapeutic environmenent. N/A Kinship Caregiver's feelings and attitudes toward the child(ren)'s parent(s) and other family members: Ms. Wilcox reported she and her daughter had a “rough patch,” but their relationship has improved. She stated she is close to her grandson Hayden because he has lived in the home with her and Ms. McMinn. Ms. Wilcox reported Hayden does not have a relationship with his father and does not have visitation with him because of a domestic abuse charge. Hayden has several half siblings but does not have constant communication with them. Ms. Wilcox and Ms. McMinn stated two weeks ago Hayden was removed from a family friends’ home and is placed with his paternal uncle who was not following the visitation guidelines. Ms. Wilcox and Ms. McMinn reported they have not had any contact with Hayden, and they are not allowed to see him, and they do not allow any contact between Hayden and his mother, Ashleagh Wilcox. They stated having Hayden move in with a relative who is not willing to follow visitation guidelines is making the Department intervention harder on the family and they do not understand why he was moved. Kinship caregiver's initial reasons for wanting the child(ren) placed in the home: Ms. Wilcox stated Ashleagh Wilcox, and Hayden had lived with her for several years, when Ashleagh was trying to become more self-sufficient. Ms. Wilcox stated even when Ashleagh and Hayden moved out she kept a room for Hayden so he can come and visit and stay the weekends with her. Kinship caregiver's feelings and attitudes about the potential placement of a related child in their home: Ms. Wilcox stated she is very excited about having Hayden placed in the home with them. She stated she misses seeing and hearing from him and feel that his current placement with the paternal relatives is making visitation and communication with his family very difficult.She reported they are willing to follow all the guidelines with visitations and believes the current placement is withholding him from communicating with anyone and feels that is not healthy for anyone at this time. Kinship caregiver's future desires with respect to the placement: Ms. Wilcox stated she is willing to care for Hayden until his mother is able to care for him again and reported she would be fine with raising him into adulthood if she is not able to complete services with the Department. Wilcox Page 4 of 16 MA-Rev 10.30.2019 Texas Department of Family and Form 6588 Protective Services September 2017 Kinship Caregiver's history of alcohol and drug use or Present Use Describe the kinship caregiver’s history or current use of drug or alcohol, if any: Ms. Wilcox reported she will drink one drink while out at a restaurant and denied any alcohol being stored in the home. She denied drinking to excess. Ms. Wilcox self-reported she has used marijuana for pain management for her back. She reported she had been prescribed oxycodone but did not like how she felt on it and purchased marijuana on her own. She denied it being prescribed for her and stated she has only done it several times since January 2021. She denied having any marijuana in the home with her but could not disclose a date as to the last time she used. Ms. Wilcox stated at this time she uses Motrin and Advil to help control the pain and denied current marijuana use. Ms. Wilcox’s statements agree with her criminal history. Ms. Wilcox stated she had only used Marijuana to help control the pain in her back and denied being addicted to it. She reported she has not used any recently and was unable to give a specific date she stopped using. Ms. Wilcox stated in the home she does not have any illegal drugs and only uses over the counter medication like Motrin and Advil. It appears Ms. Wilcox is willing to adjust her behavior to help care for Hayden. Ms. Wilcox denied being addicted to any drugs and denied using any rehabilitative services. Kinship Caregiver’s Tobacco Use Ms. Wilcox reported she smokes cigarettes and will smoke outside of the home and does not smoke inside the home or in her car. She stated she keeps her cigarettes in the car in her glove compartment. Kinship Caregiver's history of child abuse/neglect of kinship caregiver Describe kinship caregiver’s history as a victim of child abuse (physical and sexual) and neglect, if any: Ms. Wilcox denied any history or child abuse or neglect. Kinship caregiver's rehabilitative activities, if any: If kinship caregiver has a history of child abuse and neglect, assess kinship caregiver's ability to provide a safe environment for children. Ms. Wilcox denied any history of child abuse or neglect and denied any rehabilitative activities. Findings from Caregiver's Abuse/Neglect and Criminal History Checks, if any: Ms. Wilcox denied having any criminal history and her report dated 4/28/2021 supported that statement. Ms. Wilcox denied having any FPS history and the reports dated 4/28/2021 supported that statement. Ms. Wilcox stated she lived in VT as an adult from 1986-1991 while living with her husband and his family. Background reports should be requested from CT in order to rule out risk. Findings from Abuse/Neglect and Criminal History Checks for any household member over the age of 14, if any Ms. McMinn denied any criminal history, and none was seen on reports dated 4/28/2021. Ms. McMinn denied any history with FPS, and none was seen on report dated 4/28/2021. Ms. McMinn stated she has not lived outside the state of TX. Below, describe that discussion, including the kinship caregiver's reaction: Ms. Wilcox does not have any criminal or CPS history that would impact her ability to act as kinship placement. It was explained to Ms. Wilcox that approval for kinship placement depends on whether she has disclosed all relevant information to DFPS and whether any FPS or criminal history emerges following approval as a kinship home. Ms. Wilcox reported that she understood and was not concerned. It was also discussed that other household members’ criminal and FPS history could negatively impact her kinship placement, and she stated she understood. It was discussed that frequent visitor, transporters, emergency back-up caregivers, and babysitters with criminal and FPS history may be denied access to the home and child being considered for placement. Family Relationships Family of Origin: Ms. Wilcox stated she was born in Pasadena TX and raised in Houston, TX. She was born to Helen McMinn and stated she did not know her biological father. She stated they were married when she was born but they were divorced when she was young and denied having any contact with him and did not receive any child support. She reported being raised by her mom and stepdad Noel Marion Cowan. She stated her mother worked several jobs as a secretary and stated she is now retired. She stated her stepfather was a car salesman and died in 1982 from a heart attack. She reported growing up her mom and stepdad provided a safe and stable household. Ms. Wilcox was raised with two siblings. Donna Sue Boyd, she lives in KS and is retired, she is not a frequent visitor. Charles Lynn Kirk, he died in 1999 from a heart attack, he had been addicted to drugs and that led to his death. Ms. Wilcox stated she was close with her sister growing up and that her mom and stepdad would ground them or not let them go out if they “acted up”. She denied the punishment being abusive in nature and stated she believes they were all treated the same. Ms. Wilcox reported graduating high school in 1982 from Whitehouse High School and stated she did not move out of the home until she was 21 years of age. Previous relationships: Ms. Wilcox reported one prior relationship. James Wilcox – She reported they met in Kansas and were both on a recreational softball team. They couple dated for 13 months and lived together for a year before getting married in CT on 4/29/1989. The couple had two children together, Ashleagh Wilcox and Casey Wilcox born 8/7/1991. Ms. Wilcox stated Ashleagh works at IHOP and has a current CPS case, and her son Casey works at Home Depot in FL and does not have any children and is not married. Ms. Wilcox stated her marriage dissolved because her Name of Family Studied: Linda C. She reported the children lived with her and she would receive money from Mr. Wilcox when he could help. Ms. Wilcox reported they got along for the children and coparented the best they could. Ms. Willcox denied there being any history of the children abusing alcohol or drugs and denied her children having any criminal history. Current relationships (married couple): N/A Couples with children: N/A Single parent caregivers: Ms. Wilcox stated her support system is her mother Ms. McMinn and her best friend Dana . She stated in the past she had worked in the summer, but this was the first summer she is taking off the whole summer to care for Hayden. Ms. Wilcox denied dating anyone and stated she is not interested in dating at this time. Ms. Wilcox reported she believes she is a good caregiver and stated she raised her two children into adulthood. She believes Hayden will be comfortable in the home because he has his own room, and he is used to living with her and staying in the home with her. Children Currently in the home: N/A Other household members: Ms. McMinn was interviewed by herself in the home and stated she is the great grandmother of Hayden and has been in his life since he was born. She stated she has lived with Ms. Wilcox for years and they are both in agreement with having Hayden in the house with them while his mother is receiving services from the Department. She denied any history of alcohol or drug abuse and stated she quit smoking back in 1991. Ms. McMinn retired over 10 years ago and is receiving her retirement only as income and stated with that she helps pay for the cost of the home with Ms. Wilcox. She stated she will be responsible for doctor’s appointments and other appointments if Ms. Wilcox is at work. She denied being a part of any outside organization and stated she does not have any other obligations that would limit her ability to care for Hayden. She reported being in good physical health and stated she has lower back problems and was diagnosed with degenerative disk disease for which she takes hydrocodone for the pain. Ms. McMinn stated she is also taking Tamoxifen for her breast cancer and stated she has been in remission for 5 years. She reported she keeps her medication in her room in the top drawer outside of the reach of children. Ms. McMinn purchased a medication safe that will prevent Hayden from having any access to her medication. Ms. McMinn reported every 4-5 months she receives injections in her back to kill the nerves and stated those appointments she has Ms. Wilcox drive her to UT in Tyler . Ms. McMinn stated she is able to take medication without any negative side effects and reported her injections as being the only treatment that will make her tired and at that time, she would not be able to help with Hayden but the next days she will be fine. Wilcox Page 7 of 16 MA-Rev 10.30.2019 Texas Department of Family and Form 6588 Protective Services September 2017 Family Functioning Kinship caregiver health (physical, mental and emotional of each kin caregiver): Ms. Wilcox reported she had neck surgery in 2001 following a wreck she had. She reported she also had herniated disk surgery in December of 2020. She stated she is prescribed Flexeril for her pain and stated she is prescribed it three times a day but only takes it once a day. She reported she has allergies and will have an inhaler but reported she rarely uses her inhaler. She stated she feels like her health is overall good and she feels like she is doing better and is able to increase her steps she takes and does not feel as if she has any limitations or disabilities she is concerned about. Ms. Wilcox denied receiving any counseling services for mental health concerns. She denied ever being prescribed medication for any mental health problems and denied being hospitalized for any psychiatric services. Family rules and boundaries: Ms. Wilcox reported Hayden is responsible for cleaning up his toys after he is done playing with them. She stated he has his own room and helps keep his own room clean. Hayden is not allowed into Ms. Wilcox’s bedroom or Ms. McMinn’s bedroom without their permission. She reported he helps pick up his own dishes and puts them in the sink. Hayden has his own bedroom and that iswhere he is able to change and have his own privacy. Handling Stress and Expressing Negative Feelings: Ms. Wilcox stated she does not get very upset easily and reported she will sit out in the sun and tan and relax. She reported she also will read and talk to her friends to help destress. It appears Ms. Wilcox has appropriate means to manage her stress. Kinship caregiver’s home: Ms. Wilcox lives in a three-bedroom two-bathroom home in Longview, TX. The entire home was walked through at the time of the interview. Ms. Wilcox sleeps in the master bedroom which was appropriately furnished and tidy. Ms. McMinn has her own private bedroom which is appropriately furnished and tidy. The spare bedroom is Hayden’s room which has a full bed . The room appears to have enough space for his belongings. The home has an alarm system on the doors and windows and notifies if any of them are opened. The home has appropriate smoke detectors in all living areas and a new fire extinguisher is observed in the household. The remainder of the home was walked through and includes a living room, dining room , garage and enclosed backyard area. The entire backyard is fenced in and there are no swimming pools or trampolines stored on the property. Ms. Wilcox reported her medicine is stored in the kitchen outside of the reach of any children and reported Ms. McMinn’s medication is stored in her top drawer of her dresser outside of the reach of any child. Cleaning material was observed on top of the laundry room outside of the reach of any children. Ms. Wilcox stated Hayden’s mother lives 45 minutes away and she is unsure where Hayden’s biological father lives. She reported anytime they play outside he is always with an adult, and they will normally play in the front yard of the home because her neighbors have dogs that get excited and willbark a lot.Ms. Wilcox stated in the home all of the doors are open at night so if Hayden wakes up in the middle of the night he can be heard. She reported she helps Hayden with filling the bath for him and will check in on him, but he is able to wash himself with minimum assistance. Ms. Wilcox reported she will have Hayden on a routine while in her home, it appears she is aware of proper supervision. Ms. McMinn has a 38-special handgun in her room locked in a safe. She has her ammunition stored in the closet. Ms. Wilcox and Ms. McMinn were informed of storage requirements made by the Department. Ms. Wilcox stated she understood the firearm and ammunition must be stored separately and under double lock and stated she would get another safe. At the time of submission update to storage has not been completed. Ms. Wilcox reported Hayden is able to swim with his flotation devices and he does not go in the water without being with an adult. Ms. Wilcox reported being certified for CPR, training record verified with date of completion 5/31/2021 and valid until 5/2023. She stated if there was a medical emergency, she would be fine calling 911. Safety, related to child(ren)’s issues: Ms. Wilcox reported Hayden has been diagnosed with allergies and will have breathing treatments that he does for his lungs, and he will take over the counter medication Tylenol or Motrin when he gets fevers. Ms. Wilcox reported Hayden and his mother both had suffered from seizures when they had high fevers. She denied him being prescribed any medication and stated her daughter outgrew the seizures and she does not recall her having them in her teens. Ms. Wilcox stated she believes her grandson Hayden, will outgrow them as well. Ms. Wilcox stated she and Ms. McMinn will be responsible for all driving to and from appointments. Ms. Wilcox was asked if Hayden’s mother would visit outside of visitation, and she reported she would not because she does not work in the area or live in the area. Ms. Wilcox reported Ashleagh Wilcox is very worried of having a stranger care for Hayden, she is willing to follow the guidelines of visitation. Discipline: Ms. Wilcox reported she has taken care of Hayden since he was born and had always talked with him to reset bad behavior. She reported she would get at eye level with him and remind him of the rules and talk about his behavior. Ms. Wilcox stated Hayden would sit in time out and think about what he had done and then would be able to return what he was doing. Ms. Wilcox denied using any physical punishment and it appears her current practice is compatible with those endorsed by DFPS. Child-care knowledge: Ms. Wilcox stated she has 2 children that she has raised since birth into adulthood. She also stated she teaches 5th and 6th grade children and has almost 20 years of experience of childhood education . She reported she has experience in classroom teaching children who may act out and has experience deescalating those instances. Child management: Ms. Wilcox stated she has experience working with children who are in special education and has been able to talk and address their needs by speaking on their level. Emergency Care Plan: Ms. Wilcox stated her mother Ms. McMinn would be listed as emergency caregiver. Ms. Wilcox reported Ms. McMinn had previously been listed as a supervisor for visitation for Hayden while he was placed temporary with family members. Financial situation: Ms. Wilcox stated she has been a teacher for 20 years moving between different school districts in Tyler and Longview as a special education teacher and being a teacher of 5th and 6th graders. Income verified by pay stubs for Ms. Wilcox. Ms. McMinn is retired and receives Supplemental Security Income and Teachers Retirement. Income verified for Ms. McMinn by the benefits letter from SSI and W2 for TRS. Ms. Wilcox and Ms. McMinn stated they are responsible for paying their own bills and both contribute to rent. They denied filing for bankruptcy and stated they are both in charge of paying their own bills. Ms. Wilcox reported her vehicle isa 2016 Jeep Patriot that seats 5 and Ms. McMinn stated her car is a reliable 2010 Chevrolet Cobalt that seats 5. They reported the vehicles are covered by AAA. It appears the amounts are realistic for the household. She was informed once Hayden is placed in the home any WIC or Food Stamps assistance can be applied. She stated she believes she will be able to maintain the household without any additional assistance. Ms. Wilcox was informed there would be limited financial assistance for kinship placement and stated she was not worried about it. Permanency Child(ren)’s involvement with the kinship caregiver: Ms. Wilcox stated her daughter Ashleagh Wilcox and her son Hayden had lived with her and her mother Ms. McMinn for three years. She reported her mother Ms. McMinn was a primary caregiver to Hayden because she was retired, and she would care for him while Ashleagh Wilcox worked. She reported Hayden enjoyed being inthe home with them and they had even cared for him after Ashleagh Wilcox moved out with Hayden. She reported Hayden was a frequent visitor and that he still had his bedroom made up in the home for the time that he spent that night. She stated Hayden enjoys staying at the home because they get to play outside, and he is well taken care of. Kinship Caregiver's plan to support the child(ren)'s permanency plan: Ms. Wilcox stated Hayden does not have any contact with his biological father because of domestic abuse charges. She reported her daughter Ashleagh Wilcox is able to call and talk to her son and there were supervised visitations. Ms. Wilcox stated she would be willing to follow the visitation guidelines and do what ever is instructed of her to have Hayden in the household. She believes Ashleagh Wilcox is doing what she has to do to get Hayden back and does not see the placement going over a year. But she reported if her daughter was not able to get Hayden back, she would be interested in raising him into adult hood. Ms. Wilcox stated Hayden has several half siblings, but he is not very close to them because he is not able to be around his biological father, so he does not have regular contact with his half siblings. She stated he has not been diagnosed with any mental health and isnot aware of any behavioral problems. Ms. Wilcox stated Hayden has always been monitored when his allergies were acting up because he may have a seizure if his fever gets too high. She stated she is not aware of any medication he is taking for that and reported none of his doctors have diagnosed him with seizures and stated itwas just something they had observed but were never able to have a doctor present when it happened. Ms. Wilcox stated she isa teacher and during the summertime frame she normally would work during summer school but is taking off this summer to help care for her grandson. Ms. Wilcox stated if Hayden was stillplaced with them at the time of the school year beginning her mother, Ms. McMinn would help watch Hayden if he was off of school. She stated she would be able to have Hayden be dropped off at her school and wait for her in her class until she is done with class and would be able to work out the transportation for Hayden with the principal. Itappears Ms. Wilcox has reviewed several options for care for Hayden while in her care. Dealing with children who have been physically, sexually abused and/or neglected: Ms. Wilcox reported she had experience with teaching a class with children who had behavioral issues and was used to deescalating issues with children who were acting out. Ms. Wilcox was asked if she felt she would be able to help her grandson Hayden if he acted out aggressively and she reported she would. Relative Support Systems Needed supportive services: Ms. Wilcox stated she would not need any additional services because of family and work support she would be able to manage without any assistance.
