Durbin at the police department in reference to theft of a Food Stamp Reimbursement Card. Diane reported she is the legal guardian of her grandson Devon Grinder (13 Years of Age/Victim). Officer Durbin was told that Gayle Monty is Devon's mother (Diane's daughter in law/Involved other), and she has been incarcerated since March 2020. Diane reported that Devon's father was deceased. Diane told Officer Durbin that she home schools Devon and due to home schooling him, she applied for a Food Stamp Reimbursement Card which she-never received. Diane stated she called DCF to find the status on the card and was told the card was mailed in May of 2021. Diane then called The Food Stamp Program (Federal Refund) and was told the card for $1,100.00 U.S. dollars had been used last at 1125 SE Port St. Lucie Blvd (Publix) on October 10, 2021. Diane provided Officer Durbin with a potential suspect named she Danielle Bonfiglio (Suspect). Diane added that Danielle knows Gayle’s full name, social security number, and her date of birth due to residing with Gayle in the past. Agency Case # 202124809 Page 1 of 6 Bonfiglio, Danielle St. Lucie County File Date: 02/11/2022 1 0 AM562022CFO00348AXXXXX ‘On November 18, 2021, Officer Durbin spoke with Danielle Bonfiglio. Officer Durbin explained to her why he was there, and Diane told Officer Durbin that she did not know where the card was, and she never saw it before. Detective investigation: On November 24, 2021, | spoke to with Diane and learned the following: She provided me with a St. Lucie County Court document (Petition for Temporary Custody by Extended Family/Court case #56-2020-DR-001058) in reference to having temporary custody of Devon. | confirmed the validity of the document via St. Lucie County Clerk of Court and confirmed that Diane has had temporary custody since March 2020 and it was finalized on September 8, 2020, per the court documents. Therefore, Diane is responsible for Devon. Diane stated since she is responsible for Devon and has been homeschooling him, he qualified for monies provided by the Florida Department of Children and Families (DCF)/Pandemic Electronic Benefits Transfer (P-EBT) in the amount of $1,100.00 U.S. Dollars. Diane applied for this benefit in April 2020. Diane never received the card and initially assumed it was lost until she called P-EBT which is when she learned it had been stolen and the monies were already used. Diane strongly believed Danielle was the suspect because Gayle had previously lived with her, and she believed it would be easy for Danielle to know all of Gayle’s personal information in order to change the pin number on the P-EBT card. Additionally, Gayle has had her mail forwarded to Danielle's residence which is why she thinks the P-EBT card was mailed to Danielle’s residence by mistake. Diane believed Gayle has had her mail forwarded since January 2020. | contacted Elena Estopinan who is a Public Benefits Investigations Supervisor with the Office of Public Benefits Integrity (Centralized Special Investigations Unit). Elena was notified that this was an active criminal investigation; therefore, she provided me the following information: The card was issued to Gayle for Devon. The total benefits provided was $1,200.32 US Dollars. The P-EBT card (Card 4] was mailed to 1042 NW Bayshore Blvd (Diane's address; however, since Gayle has her mail forwarded to Danielle's residence it is presumably believed that it was sent there). Additionally, Elena provided me with the P-EBT transaction history as well as a case report which shows that the PIN number was changed on May 11, 2021, at 1102 hours. The last four of the P-EBT card numbers matched the numbers on the receipt. #27 - Retrieved video surveillance and | was provided a receipt (Receipt ID #8997340522525335321) for the transaction which was a total of $24.35. The last four of the P-EBT card numbers matched the numbers on the receipt. #29 - Retrieved video surveillance and | was unable to obtain a receipt for the transaction which was a total of $4.00. #31 - Retrieved video surveillance and | was provided a receipt (Receipt ID #76700138187151 10264) for the transaction which was a total of $19.34. The last four of the P-EBT card numbers matched the numbers on the receipt. #33 - Retrieved video surveillance and | was provided a receipt (Receipt ID #3709227025304739765) for the transaction which was a total of $56.40. The last four of the P-EBT card numbers matched the numbers on the receipt. #35 - Retrieved video surveillance and | was provided a receipt (Receipt ID #5554471396684424) for the transaction which was a total of $35.10. The last four of the P-EBT card numbers matched the numbers on the receipt. #37 - Retrieved video surveillance and | was provided a receipt (Receipt ID #23482126932609) for the transaction which was ja total of $6.00. The last four of the P-EBT card numbers matched the numbers on the receipt. #38 - Retrieved video surveillance and | was provided a receipt (Receipt ID #2225) for the transaction which was a total of $17.35. The last four of the P-EBT card numbers matched the numbers on the receipt. #39 - Retrieved video surveillance and | was provided a receipt (Receipt ID #6891) for the transaction which was a total of $35.34 which was declined due to insufficient funds. ‘Applicable business record certifications were completed. | reviewed Danielle's Florida driver's license picture and in the above listed transactions which had video surveillance, they all appeared to match Danielle‘s build/facial features. On December 16, 2021, | met with Diane to continue to discuss this investigation. | asked Diane if she would be able to identify Danielle and she said yes due to knowing her for over ten (10) years. | showed Diane a picture of Danielle’s driver's license and she confirmed her identity. This conversation was audio recorded. On February 10, 2022, | met with Diane and showed her nine (9) screenshots of the video surveillance which captured Danielle's transactions. These screenshots were from transactions: #23, #27, #29, #31, #33, #35, #37, #38, and #39. Diane positively identified Danielle in all nine (9) screenshots and this conversation was audio recorded. | utilized TransUnion TLOxp (Law enforcement online database search tool) and confirmed that Danielle's phone number was 772-708-5904 per their database. Additionally, | utilized RMS and confirmed that Danielle's number had been previously used in the database. On December 14, 2021, | requested a subpoena for Danielle's registered phone records linked to her phone number - 772-708-5904 (T-Mobile). On December 28, 2021, | received the phone records and confirmed that Danielle was the subscriber to the phone number. Based upon the information Elena provided me, | reviewed calls placed on May 11, 2021, when the PIN number was changed. T-Mobile records confirmed that three (3) calls were made on May 11, 2021, at 1456 hours (62 seconds long), 1500 hours (96 seconds long), and 1503 hours (39 seconds long) to 1.888.356.3281. The main number for Florida’s EBT customer service number is 1-888-356-3281 which can be utilized to reset a PIN number. The calls placed matched the case report that Elena had provided me. | contacted the St. Lucie County Jail and received Gayle’s jail calls. On #238 jail call - Site ID 20539, Danielle’s phone number (772-708-5904) was dialed from Gayle’s inmate pin #186543 from B5-Dorm 3-1 telephone. The conversation was at 1622 hours and lasted 12:28 long. This is a synopsis of the phone call with 772-708-5904 and Gayle: -Danielle asked Gayle how much information | can tell you over the phone. |-Danielle said to Gayle that Diane's food stamp card was missing, and that Diane had law enforcement come question her Agency Case # 202124809 = & Page 4of6 -. :. +: Bonfiglio; Danielle St. Lucie County File Date: 02/11/2022 11:50 AM562022CFO00348AXXXXX about Gayle’s food stamp card on that day (November 18, 2021). Danielle reported that it was reference the food stamp card that was "missing in action". Gayle was confused by what Danielle was telling her. Danielle was aware of the option to apply for extra food stamps for children. Gayle denied being involved because she was incarcerated, and Danielle stated she did not know where the food stamp card was. Gayle told Danielle the usage can be reviewed as well as she has not received any food stamps since she last lived with Diane. Danielle denied knowing where the food stamp card is and insinuated that Michael got ahold of it. Again, Gayle was very surprised by this event and Danielle repeated that Michael must have gotten ahold of the food stamp card. I listened to a separate jail call between 772-708-5904 and Gayle. On #2 jail call - Site ID 20539, Danielle’s phone number (772-708-5904) was dialed from Gayle’s inmate pin #186543 from D1-Dorm 06-2. The conversation was at 2057 hours and lasted 19:51 long. It appeared that another phone call was connected via 3-way and a male spoke several times. After listening, the voice sounded like Michael Ewing (Involved other). | have dealt with Michael twice in a law enforcement capacity land do believe that was his voice. It should be noted that Michael was incarcerated at the St. Lucie County Jail from May 15, 2021 - June 19, 2021, and has been currently incarcerated since August 27, 2021. Therefore, | do not believe Danielle's prior statement that Michael stole the EBT card. It should be noted that Danielle is engaged to David Ewing which is Michael's brother. On February 10, 2022, 1538 hours, Danielle responded to the police department for an interview. Danielle was placed into room #346, Danielle completed a written Miranda Rights waiver and agreed to speak with me. | explained to Danielle why she was brought there for an interview. Danielle was shown some of the screenshots that | previously showed Diane. Danielle stated that was not her and denied ever using any EBT cards except hers and her David's. When | confronted Danielle with more evidence to substantiate that she had utilized the stolen P-EBT card, she denied it. A few moments later, Danielle told me that she was the power of attorney of all of Gayle’s finances and was allowed to utilize any EBT card sent to her. Danielle was not forthcoming and appeared to be deceptive when | asked additional questions. After | explained to Danielle that she lwas going to be arrested, Danielle requested an attorney. The interview was then stopped. The interview room had audio/video recording and it recorded the interview. The recording of the interview was submitted onto the Foray server. | determined that Danielle violated the following Florida State Statutes: |-814.014 (2C1) Grand theft - Danielle did knowingly spend $1,200.32 while utilizing the P-EBT card. -817.034 (4A3) - Organized Scheme to defraud (Obtain property under $20,000.00). Danielle did knowingly and systematically utilize the P-EBT card over forty (40) times which shows an ongoing course of criminal activity. -817.60 (8) - Stolen credit card. Danielle received and was in possession of a stolen P-EBT card. |-817.61 - Unauthorized use of a credit card 817.61 (Nine (9) counts). Danielle did intentionally defraud Florida EBT by utilizing {a P-EBT card that was not issued to her. }-817.02 - Obtaining property by false personation. Danielle falsely personated Diane by calling P-EBT and resetting the pin #. Ultimately, Danielle did receive the monies associated with the P-EBT account as well as assumed Diane's identity by doing so. -414.39 (5B) - Fraud (Food assistance benefit) - Danielle did knowingly use a P-EBT card in a manner not authorized by law. ‘The value of the public assistance was wrongfully received and an aggregate value of $200 or more, but less than $20,000 in less than 12 consecutive months. Danielle was subsequently transported to the St. Lucie County Jail without incident.
