COMES NOW, pursuant to Rule 1.440(b), Fla.R.Civ.P., SCYLARK-SCHIPPERS, LLC, by and
through its undersigned counsel, and files and serves this Notice That Action Is at Issue and ready to
be set for trial. SK YLARK-SCHIPPERS, LLC would further show:
1. There are no pending motions directed to the last pleadings and more than twenty (20) days
have elapsed since service of the last pleading.
2. The trial is to be on the TREASURE ISLAND CAFE, LLC’s Complaint and SKYLARK-
SCHIPPER’s Counterclaim and it is estimated that one (1) day will be required for trial.
3. The trial is to be by non-jury.

and through its undersigned counsel, and also submits this Motion to Schedule Case Management
Conference. SK YLARK-SCHIPPERS, LLC requests such conference in an effort to:
1. Coordinate the progress of the action.
2. To set the time of trial, subject to Rule 1.440(c), Fla.R.Civ.P.

Motion and enter an Order scheduling a Case Management Conference in this action.
