Prior to the hearing all parties to the motion will be asked to sign a stipulation agreeing that the motion may be heard by the Pro Tem Judge. If all parties to the motion sign the stipulation, the hearing will proceed before the Judge Pro Tem who will decide the motion with the same authority as a Superior Court Judge. Plaintiff's "motion for award of attorneys' fees, costs, and expenses" in this lemon law case is granted in the total amount of $80,000. To avoid further time consumption, this includes fees for reply papers and any oral argument. The opposition largely focuses on "excessive" discovery motion practice. But this was due to defendant's own discovery recalcitrance, which ended only after the court gave defendant "one more chance" rather than grant terminating sanctions. (Memo. 7:25.)
