This is an action for breach of contract against Defendant. Plaintiff is the owner of

the building located at 262 West 15th Street, New York, New York 10011. Plaintiff, as landlord,

and Defendant, as tenant, entered into a commercial lease dated August 15, 2019 (the “Lease”)

relating to a portion of the ground floor at that location (the “Premises”). Defendant, now a

holdover tenant, has breached the Lease with Plaintiff by, inter alia, operating a restaurant at the

Premises without (i) required approval of, or permits from, the New York City Department of

Buildings (“DOB”) for its plumbing work; (ii) a permit from the Department of Health to operate

a restaurant; and (iii) the insurance required by the Lease. Accordingly, Plaintiff seeks the

damages permitted by the Lease and an injunction barring Defendant from operating its restaurant

in contravention of the Lease and New York City regulations.
