Colloquy regarding progress of case. COURT NOTED, both sides have selected an I.M.E. and they are ready to go forward with a meaningful settlement conference. Memorandum outlining process to schedule settlement conference was provided to Mr. Cardoza. Mr. Cardoza advised he still has not received the records that identify dental treatment facilities ie: names, locations and Dentists that provided prior treatment to the Pltf. within ten days. COURT directed Mr. Cardoza to prepare an Order from the last hearing which shall be signed by the Court and upon serving Deft's counsel advise him that the Court will find him in contempt for failure to provide same.

Discussion was conducted regarding potential for settlement, remaining discovery to complete and setting of Mediation or Settlement Conference. COURT ORDERED as follows: Deft.'s counsel shall depose and have an Independent Medical Exam (IME) done on or before 10/23/07 and will attempt to arrange IME/Depo. at the same time to avoid additional trips from Florida by the Pltf.. To the extent Pltf. can locate records that identify dental treatment facilities ie: names, locations and Dentists that provided prior treatment to the Pltf., this list shall be provided to Deft's counsel within TEN (10) DAYS. Additionally Deft's counsel to provide Pltf's counsel a copy of the driver's employment file within TEN (10) DAYS. Matter set for Status Check.
