| March 16, 2010 | Docket Event | FINDINGS, RULINGS AND ORDER FOR JUDGMENT After evidentiary hearing on assessment of damages, the Court finds that plaintiff was assaulted on November 11, 2008 by defendant, who was a passenger in his taxi, who smashed him in the face, breaking his facial bones and requiring plastic surgery two times, involving plates being screwed into his facial bones. He still has pain and loss of hearing from the assault. He also suffered bruises on his back when the defendant slammed plaintiff against his cab, breaking the cab's mirror. Defendant was subsequently convicted in the Cambridge District Court of aggravated assault and battery and malicious destruction of property. His medical bills total $79,401. In addition to these medical expenses, the Court finds fair, reasonable and adequate compensation for his pain and suffering to be $150,000.
