The parties' stories are diametrically opposed, such that I cannot find, at this point, that the plaintiff has demonstrated a "reasonable likelihood that (it) will recover judgment." See M.R.Civ. P. (4) (c). Moreover, the amount of the alleged damages appears entirely speculative. Lastly, the contract, prepared on plaintff's letterhead and presumably drawn by plaintiff, does contain the language: "Clearing of approximately 80 acres in exchange for wood. Should Emergency Forest Restoration Program (EFRP) become available ...." This language, and the absence in the contract of any dollar figure plaintiff would receive if grant funds were not forthcoming, tends to lend some corroboration to defendants' contentions.
