Plaintiff, Webster Bank, N.A., shall receive $3,788.58 from the $42,053.21 in surplus proceeds to compensate it for the costs and fees it incurred related to this immediate action. 2. Defendant, BAC Home Loan Servicing, LP., as the party with the most senior lien position amongst those named in this action, shall receive all surplus proceeds remaining after Webster Bank, N.A. receives compensation for its costs and fees associated with this action, as stated in Paragraph 1, above. The amount remaining from the surplus proceeds, payable to BAC Home Loan Servicing, LP shall be no less than $38,264.63. 3. Defendant, City of Attleboro, having already received full compensation for the amounts claimed in its Answer (see Docket at Paper No. 9), shall take nothing from the surplus proceeds. 4. Each party is to bear its own costs associated with this action and expressly waives any right to recover the same from the surplus process, except as explicity stated in Paragraph 1, above. | |
