The matter was continued from 11/27/2018 due to the Petitioner being at the hospital in labor. All parties are present. The Court advised the Respondent of his 5th amendment rights. The Respondent wished to proceed. The Court heard testimony from the parties as to the incidents listed on the request of a restraining order. The Court finds there has been at least one act of domestic violence. Court finds the Petitioner has met her burden of proof and The Court grants the request for a restraining order, the order will be in effect for 5 years. The mother will be granted sole legal and sole physical custody, with no visits to the father pending his release from custody. A full custody was prepared on today's date and provided to the mother. The father's copies will be sent to him at the Fresno County Jail. The Court noted that the father left the courtroom after the mother stated that the newborn child passed. The Court will grant the request for property control over the 1990 Mercedes In addition the Court finds that there is a current Criminal Protective Order in case F18905325 that is set to expire on 08/09/2021.Existing orders remain in full force and effect. Restraining Orders (CLETS): The Restrained person is: CHRISTOPHER VAUGHN JACKSON The Protected person is: JUSTINA R PERRY The family protected and household members are: AALIYAH JACKSON and ZION JACKSON Personal Conduct Orders: The restrained person must not do the following things to the protected people listed in this paperwork: a. harass, attack, strike, threaten, assault (sexually or otherwise), hit follow, stalk, molest, destroy personal property, disturb the peace, keep under surveillance, or block movements b. Contact (either directly or indirectly), telephone, or send messages, or mail or e-mail c. Take any action, directly or through others, to get the addresses or locations of any protected persons or of their Family members, caretakers, or guardians. (If item C is not checked, the Court has found good cause not to make this order.) Peaceful written contact through a lawyer or through a process server or another person in order to serve legal papers is allowed and does not violate this order. Stay-Away Order The person restrained must stay at least 100 yards away from the protected person and: Home; Vehicle; Job or workplace of protected person; Other protected persons named in paperwork; Children's school or child care. Child Custody and Visitation See attached order filed on 12/11/18 No Guns or Other Firearms or Ammunition The person restrained cannot own, possess, have, buy or try to buy, receive or try to receive, or in any other way get: a. Guns, other firearms, or ammunition. b. The person restrained must: Sell to a licensed gun dealer or turn in to a law enforcement agency any guns or other firearms within his or her immediate possession or control. This must be done within 24 hours of being served with this Order. File a receipt with the court within 48 hours of receiving this Order that proves guns have been turned in or sold. (Form DV-800, Proof of Firearms Turned in or Sold may be used for the receipt.) Record Unlawful Communications: The person protected has a right to record communications made the person restrained that violate the Judge's orders. Property Control: Only the protected person can use, control, and possess the following property: 1990 Mercedes Criminal Protective Order: F18905325, Fresno County, Expires: 08/09/2021 Restraining Orders Expire on: 12/11/2023 at MIDNIGHT.
