Minute order - Judge Snauffer Minute Order from Dept.: 501 Clerk: L. Whipple Reporter: N/R Nature of Hearing:Summary Judgment Taken out from under advisement Tentative ruling becomes the order of the court. No further order is necessary. Pursuant to CRC 391(a) and CCP section 1019.5(a), no further order is necessary. The minute order adopting the tentative ruling serves as the order of the court. Service by the clerk will constitute notice of the order. See attached copy of Tentative Ruling. To deny the motion by First American Title Company, and to grant the motion by Jack Gregory, Carole Gregory, John Avila, and Kimberlee Avila for summary adjudication of the second, third, and fourth causes of action. The evidentiary objections of First American Title Company are overruled as irrelevant because it did not meet its burden. The Court has not considered the reply separate statement of facts submitted by Jack Gregory, Carole Gregory, John Avila, and Kimberlee Avila. There is no statutory provision permitting supplemental separate statements or additional evidence to be filed with the reply. (Code Civ. Proc. 437c, subd. (b)(4); San Diego Watercrafts v. Wells Fargo Bank (2002) 102 Cal.App.4th 308, 312-316.) The evidentiary objections of Jack Gregory, Carole Gregory, John Avila, and Kimberlee Avila are overruled as irrelevant, because the Court did not rely on the evidence objected to in finding there was no triable issue of material fact.
