TENTATIVE RULING On June 29, 2022, Plaintiff, Disability Rights Education and Defense Fund (Plaintiff) filed a Complaint for Declaratory and Injunctive Relief and Petition for Writ of Mandate. Plaintiff has twice requested the same public records from Defendant, Stockton Unified School District (SUSD) relating to the construction and modification history of SUSD’s high school facilities in relation to serving student with disabilities. Plaintiff claims that SUSD has ignored the requests. Plaintiff is seeking an order compelling SUSD to comply with the request without further delay and judgment for nominal damages, with reasonable attorneys’ fees and costs. On calendar is Plaintiff’s Motion for Summary Judgment. By it, Plaintiff is requesting that judgment be entered in its favor and that SUSD be ordered to immediately disclose responsive records to the full extent required by law.
