Defendant’s Motion to Exclude Plaintiff’s Undisclosed Injury Claims and Damages is DENIED. This Court finds that Plaintiff’s interrogatory answers were incomplete and evasive, and clearly merited the issuance of an order compelling further answers and an award of monetary sanctions. To address the unfairness to the Defendant, this Court is willing to continue the trial, and mandatory settlement conference. Additionally, this Court is willing to extend the time for discovery to close. Finally, this Court is willing to allow Defendant to file any applicable Motions to Compel Further Responses, and ask for monetary sanctions. This ruling, of course, does not foreclose Defendant from timely raising an objection in the future to any specific documentary evidence that it believes should have been identified or produced in response to a lawful encompassing discovery request.
