This is a probate action in which petitioner, a residual beneficiary of the Robert L. Forsythe and Brenda D. Gormley Revocable Trust, seeks a court order: (1) construing the language of the trust to conform to decedent Robert Forsythe’s alleged intent that the provisions in the Trust regarding the property at 2166 Wedgewood Way, Santa Rosa, CA are not subject to amendment by Brenda Gormley; and (2) to instruct the trustee that if Gormley does not elect to rebuild and re-inhabit the dwelling on the property which was destroyed in the Tubbs fire, the property shall be sold and the sales proceeds, together with any fire insurance proceeds received related to the dwelling and structures, shall be distributed in accordance with section 6.2 of the Trust, as amended.
