This Tentative Ruling is made by Judge Noël Wise The Motion by Plaintiff Sky Partners Inc. ("SP") for Preliminary Injunction is GRANTED.

Whether a preliminary injunction should be granted involves two interrelated factors: (1) the likelihood that the plaintiff will prevail on the merits, and (2) the relative balance of harms likely to result from the granting or denial of interim injunctive relief. (See White v. Davis (2003) 30 Cal.4th 528, 554.)

SP's evidence demonstrates a reasonable probability that it will prevail on its claims against Defendant Justin Briggs for, inter alia, misappropriation, conversion, and intentional interference with prospective economic relations. Specifically, SP's evidence establishes that SP was incorporated by its President and CEO Craig Miller on September 13, 2013. (See the Declaration of Adrian Driscoll, Exhibit B.) Briggs was an employee and Vice President of Business Development for SP. (See Miller's declaration at paragraph 3.) Briggs resigned fr
