Cross-Complainant City of Pomona (“City”) moves for a preliminary injunction to enjoin Cross-Defendants Peace Leaf Incorporated (“Peace Leaf”), Goforth, and Rivers, from operating a medical marijuana dispensary (“MMD”), which violates Pomona Ordinance No. 4096 (Pomona Zoning Code (“PZO”) .392(E)), Pomona Ordinance No. 4204 (Amends PZO .062), the Pomona Corridors Specific Plan, and Pomona City Code (“PCC”) 50-336.
Procedural History
On 6/16/17, City filed a Cross-Complaint for Abatement of Public Nuisance.
On 7/28/17, this court issued a Temporary Restraining Order (“TRO”), and set the hearing on the Preliminary Injunction
