This Tentative Ruling is made by Judge Noël Wise Plaintiff's Motion for a Protective Order to Exclude the Cumulative and Duplicative Experts of Defendants (Dr. Thornton) is DENIED WITHOUT PREJUDICE.
Motions concerning expert witness discovery must be heard on or before the 10th day "before the date initially set for trial of the action." (See Code of Civil Procedure section 2024.030.) This case was initially set for trial on May 2, 2020. That trial date was vacated, and the trial was reset for November 30, 2020. Although the November 30, 2020 trial date was also vacated, pursuant to the Court's order entered November 16, 2020, no language in the November 16, 2020 order indicated that discovery would remain open, or that the deadlines for any discovery motions were vacated or would be based on any subsequently set trial date. Therefore, the last day on which this motion could be heard, pursuant to Code of Civil Procedure section 2024.030, was November 20, 2020.
