TENTATIVE RULING
Defendant Underground Construction, Inc.’s special demurrer for uncertainty and
general demurrer are sustained with leave to amend in part and without leave to
amend in part.
Plaintiff’s complaint is uncertain. A pleading may be deemed uncertain if “it
attempts to state numerous causes of action in a very loose and rambling
manner without any attempt at separately stating them.” (Craig v. City of Los
Angeles (1941) 44 Cal.App.2d 71, 73.) Plaintiff lists various potential causes of
action in the caption before simply listing alleged facts without making any
attempt to separately state the causes of action sought to be pursued.
From the facts alleged in the body of the complaint, it appears that Plaintiff
attempted to state causes of action on the legal theories that Plaintiff’s
employment was wrongfully terminated either in direct violation of the Family and
Medical Leave Act or the California Family Rights Act or in violation of public
